Discover Barranquilla S.A.S. (“Discover Barranquilla”, “we”, “us”), identified as a simplified stock company domiciled in Barranquilla, Colombia, as the Data Controller, discloses its Personal Data Processing Policy in compliance with Statutory Law 1581 of 2012, Decree 1377 of 2013, complementary regulations, and instructions from the Superintendence of Industry and Commerce – SIC.
This Policy applies to all personal data we collect, store, use, transmit, or transfer in the context of our digital media, content, tourism promotion, reservations, and related services activities.
1. Relevant Definitions
For the purposes of this Policy, the definitions from Law 1581 of 2012 and Decree 1377 of 2013 apply, including:

Sensitive Data: Information affecting the privacy of the Data Subject or whose improper use may lead to discrimination, such as racial origin, political or sexual orientation, health data, or biometrics.

Data Controller: Natural or legal person deciding on the database and/or Processing of data (Discover Barranquilla S.A.S.).

Data Processor: Person carrying out Processing on behalf of the Controller (e.g., payment gateways, allied tour operators).
2. Purposes of Processing
We collect and process personal data for the following purposes, with prior, express, and informed consent from the Data Subject.
2.1 Service Delivery and Business Operations

Manage information requests, quotes, tour reservations, experiences, accommodations, and other tourism or content services.

Analyze website and social media behavior (pages visited, clicks, session duration) using cookies and similar technologies for experience improvement and content/marketing strategies.
2.4 Legal Compliance and Security

Comply with legal obligations in tax, accounting, commercial, and data protection matters.

Respond to requests from administrative and judicial authorities, including the Superintendence of Industry and Commerce (SIC).

Prevent, detect, and investigate fraud, illicit activities, or violations of our Terms and Conditions.
We will not process data for purposes other than those described here without prior notice to the Data Subject and obtaining new authorization where applicable.
3. Personal Data We Collect

Full name, identification number (when required for invoicing, reservation support, or operator requirements).

Billing and payment data: information needed to issue invoices and manage collections (card details may be processed directly by payment gateways per their policies).

3.2 Sensitive Data and Minors’ Data
As a general rule, Discover Barranquilla does not request or process sensitive data or data of children, adolescents.
In exceptional cases (e.g., health restrictions relevant to specific experiences), we will explicitly inform about the sensitive nature of the data, its purpose, the option not to authorize, and obtain prior, express, and informed authorization from the Data Subject or their legal representative, prioritizing the minor’s best interest.
3.3 Non-Personal and Technical Data

Anonymized or aggregated information for statistical and site/content improvement purposes.
4. Legal Basis and Authorization for Processing
Processing of personal data by Discover Barranquilla is based on:

Prior, express, and informed authorization from the Data Subject via physical, electronic, telephone means, or unequivocal conduct (e.g., checking acceptance boxes or voluntarily submitting data via forms).

Existence of a contractual or pre-contractual relationship requiring Processing for service delivery.

Compliance with legal obligations and exercise of rights in judicial or administrative processes.
Discover Barranquilla will retain evidence of the authorization granted by the Data Subject.
5. Rights of Data Subjects
In accordance with the Colombian Constitution and Law 1581 of 2012 (habeas data right), Data Subjects have the following rights:

6. Procedure for Queries, Updates, Claims, and Requests

Queries will be addressed within a maximum of fifteen (15) business days from receipt. Claims will be responded to within fifteen (15) business days, extendable by five (5) additional days.
Every request or claim must include, at minimum, the Data Subject’s name and ID, description of facts, contact address, and supporting documents/evidence.
7. Processors and Third Parties to Whom Information is Disclosed
Discover Barranquilla may share personal data with:

Due to the digital nature of our services and use of overseas technology providers, personal data may be subject to international transfer or transmission to countries without equivalent protection to Colombia.
In such cases, Discover Barranquilla will adopt appropriate contractual and security measures, including standard contractual clauses where required.

In case of security incidents compromising personal data, we will notify the Superintendence of Industry and Commerce per current guidelines.
11. Data Retention
Personal data will be retained only as long as necessary to fulfill the purposes for which it was collected or while a legal or contractual retention obligation exists.
Once the purpose is fulfilled and retention term expires, data will be deleted or anonymized, unless additional legal retention is required.
12. Processing of Minors’ Data
Discover Barranquilla does not target services to those under 18.
If processing minors’ personal data, it will always be with legal representatives’ authorization, respecting their prevailing rights.
